Terms of service
General Terms and Conditions for www.mytcm.eu
1. Provider and scope
These General Terms and Conditions apply to orders placed via the www.mytcm.eu platform.
The provider is Herba Natura Harald Noll B.V., Industriestraat 12, 7091 DC Dinxperlo, Netherlands, email: info@mytcm.eu.
The platform is intended for customers who wish to order goods for delivery. There are no on-site sales.
2. Products and product information
The products offered on www.mytcm.eu are described to the best of our knowledge. The information on the product page, in the order communication and on the respective product packaging is authoritative.
Where products are food supplements, the statutory information for food supplements applies. Food supplements are not a substitute for a varied and balanced diet and a healthy lifestyle. The stated recommended daily intake must not be exceeded. Products must be kept out of the reach of young children.
We do not provide information about effects, methods of use, therapeutic outcomes or medical treatments. Information on the platform is not a substitute for medical or pharmaceutical advice.
Health or nutrition claims are used only where permitted under the relevant EU requirements.
3. Ordering process and availability check
The display of products on www.mytcm.eu does not constitute binding acceptance of an offer to purchase, but an invitation to place an order.
By submitting the order, the customer makes a binding offer to purchase the selected goods.
After receiving the order, we check the order, product availability and the information required for processing. Since Shopify is not currently connected to a complete inventory system, this availability check is an essential part of the ordering process.
An automatic acknowledgment of receipt or a technical shop notification does not constitute acceptance of the contract.
4. Formation of the contract
A purchase contract is formed only when we dispatch the goods and confirm dispatch.
A request for payment following the availability check serves to prepare the order and does not constitute acceptance of the contract unless we expressly state otherwise.
If an order is not accepted or the goods cannot be delivered, we will inform the customer. Any payments already made will be refunded without undue delay.
The customer may cancel the order before dispatch by sending an unequivocal statement to info@mytcm.eu, provided that the contract has not yet been formed.
5. Prices, shipping costs and payment
The applicable prices, shipping costs and other charges will be communicated before the request for payment.
Payments are currently processed exclusively by advance payment following a separate payment email. Online payments through the shop are currently not available unless expressly stated otherwise.
Dispatch takes place after payment has been received and after the availability and order check has been completed.
If the price, shipping costs or availability differ from the original shop display, the customer will be informed before the request for payment and may decide whether to maintain the order.
6. Delivery and shipping
Delivery is made exclusively by shipment. Collection and on-site sales are excluded.
The delivery area, shipping method, delivery time and shipping costs depend on the delivery address, product availability and the communicated shipping terms.
Unless a different delivery period has been agreed, delivery will take place without undue delay and in accordance with the applicable consumer protection provisions.
If delivery to the address provided is not possible, we will inform the customer using the contact details supplied.
7. Retention of title
The goods remain the property of Herba Natura Harald Noll B.V. until payment has been made in full.
8. Right of withdrawal for consumers
Consumers have a right of withdrawal in accordance with the statutory provisions. Details are set out in the separate right of withdrawal instructions.
For sealed goods that are not suitable for return for reasons of health protection or hygiene, the right of withdrawal may be excluded if the seal has been removed after delivery.
9. Returns
Returns following withdrawal must be sent to the returns address stated in the right of withdrawal instructions.
The goods must be returned with sufficient postage and should preferably be insured, with proof of posting or shipment. Unpaid or insufficiently stamped parcels may be refused unless mandatory statutory rights provide otherwise.
The customer's statutory rights remain unaffected.
10. Warranty and liability
Statutory warranty rights apply.
We have unlimited liability for damage arising from injury to life, body or health and in cases of intent or gross negligence.
In all other respects, we are liable in accordance with the statutory provisions. Mandatory consumer rights are not restricted by these General Terms and Conditions.
11. Customer account and communication
The customer is required to provide correct and complete contact, billing and delivery details when placing an order.
Order-related communication is conducted in particular by email to the address provided with the order.
12. Choice of law and mandatory consumer protection
Dutch law applies unless mandatory consumer protection provisions of the country in which the consumer has their habitual residence take precedence.
This choice of law does not deprive consumers of the protection of mandatory provisions of their country of residence.
13. Amendments to the General Terms and Conditions
The version of the General Terms and Conditions available at the time of the order applies to that order unless mandatory law provides otherwise.
